Our client was T-boned at low speed. On paper, that is the crash insurance companies love: modest property damage, a client with a pre-existing condition, and a ready-made argument that nothing serious could have happened.
The medical reality told a different story. The collision aggravated our client’s pre-existing condition, and what followed was not a few weeks of soreness but multiple surgeries. Our client eventually reached maximum medical improvement, which is the point where doctors have done all they can, and was left with lasting pain and permanent impairment.
The law is clear on this: a negligent driver takes the person they hit as they find them. If a crash turns a manageable condition into a surgical one, that harm belongs to the person who caused the crash. Our job was to draw the line between where our client was before the collision and where the collision left them, and the medical evidence drew it clearly.
Then came the second problem, the one most people never see coming: the at-fault driver did not carry enough insurance to cover what the crash actually cost. We recovered the driver’s full policy limits, then pursued an underinsured motorist claim through our client’s own coverage. Combined, the recovery came to $790,000.
Two lessons live in this result. A low-speed crash is not a minor case when the injuries are not minor. And the UIM coverage on your own auto policy can matter more than the other driver’s insurance ever will. Most people find that out too late. Our client found it out with a firm that knew where to look.
