Fort Wayne, IN – Passenger in Life-Threatening Condition After Pickup Hits Parked Tow Truck on Creighton Avenue

Passenger in Life-Threatening Condition

Fort Wayne, IN (August 27, 2026) – Fort Wayne Police Department officers were dispatched shortly before 7:00 p.m. on August 27 to a crash in the 900 block of West Creighton Avenue involving a pickup truck that had struck the rear of a parked flatbed tow truck, according to a department release.

Officers began providing aid to the male passenger of the pickup truck, who was pinned inside the vehicle. The Fort Wayne Fire Department assisted with extricating him.

He was transported to a local trauma center in serious condition, which was later downgraded to life-threatening, police said. The male driver of the pickup truck sustained minor injuries and is cooperating with investigators.

The Fatal Accident Crash Team and the Air Support Unit responded to assist with the investigation, according to the department. Preliminary findings indicate the pickup truck was traveling west on Creighton Avenue when it left its lane and collided with the back of the tow truck.

Investigators are working to determine whether speed and environmental conditions contributed to the crash. At this time, alcohol is not believed to be a factor, police said.

Officers asked the public to avoid West Creighton Avenue between Broadway and Miner Street while the scene was worked, and the department said the road should be open to traffic no later than 11:00 p.m. The people involved have not been publicly identified.

This is a developing story. Details may change as the investigation continues.

Passenger Injury Claims After a Fort Wayne, Indiana Crash

A passenger is in a different legal position than either driver. Fault still has to be proven from evidence, but a passenger did not choose the speed, the lane, or the moment of impact.

When someone is hurt this badly, the practical steps in the first days matter more than most people expect:

  • Get every treating record from day one. A trauma admission generates records at several departments, and insurers later question any gap between them.
  • Do not give a recorded statement to the other side. Adjusters call early, and a statement given before anyone understands the injury is used to limit the claim.
  • Preserve the evidence that disappears first. That means the pickup itself before it is repaired or scrapped, any business or doorbell camera along the 900 block of West Creighton, and the vehicle’s electronic data.
  • Do not accept an early settlement. With a life-threatening injury, the full cost of care is rarely known within the window an insurer wants an answer.

Identifying every policy that could apply is usually where the value of these cases is won or lost. That includes the driver’s liability coverage, the coverage of the vehicle’s owner if that is a different person, and the injured person’s own household policy. Indiana insurers must offer uninsured and underinsured motorist coverage under IC 27-7-5-2, and that coverage often matters when liability limits fall short of a catastrophic injury.

Indiana’s minimum liability requirement is $25,000 per person and $50,000 per accident for bodily injury under IC 9-25-4-5. A minimum policy does not go far against a trauma center bill.

Indiana also allocates fault under the Comparative Fault Act. Under IC 34-51-2-6, an injured person whose own fault is greater than 50 percent recovers nothing, and any recovery is reduced by that person’s share. Nothing reported here assigns fault to the injured passenger, and a police report is not the final word on civil liability.

Most Indiana personal injury claims must be filed within two years of the injury under IC 34-11-2-4. For an injury on August 27, 2026, that deadline is August 27, 2028.

Contact Our Indiana Car Accident Attorneys

When a family gets the call that someone was cut out of a truck and taken to a trauma center, the next several days are spent in a waiting room, not on the phone with an insurance company. That is exactly when the other side starts building its file.

Our Indiana car accident lawyer team handles passenger claims where liability coverage is thin and the medical bills are not. We locate every policy that could respond, including coverage the injured person may not know they have.

The pickup involved here will be moved, inspected, and eventually released. Its crash data and the camera footage along that block of West Creighton are the two things most likely to be gone by the time a claim is filed.

We work on contingency. Nothing is owed unless we recover for you.
