The initial investigation found that Swain was walking northbound on Scatterfield Road when the Spark struck her. She was pronounced dead at the scene by the Madison County Coroner’s Office.

What to Do After a Fatal Pedestrian Accident in Indiana

  1. Do not speak to the driver’s insurance company. They may contact the family quickly. You are not required to answer their questions or accept anything they offer before consulting an attorney.
  2. Do not sign any documents or accept any settlement. Early offers rarely reflect the true value of a wrongful death claim. Once signed, those rights cannot be recovered.
  3. Request the official crash report. Once released by the investigating agency, the crash report is a critical piece of evidence in any civil claim. An attorney can obtain it on your behalf.
  4. Contact an attorney as soon as possible. Evidence fades, and witness memories diminish quickly. Early legal involvement protects your family’s options and strengthens your case.

Indiana’s deadline: Wrongful death claims must generally be filed within two years of the date of death (IC 34-23-1-1). Acting early protects your rights and preserves critical evidence.
