Fatal Crash Claims in Indiana: Five Common Questions
The Indiana Criminal Justice Institute’s annual report counts 797 traffic deaths in Indiana in federal fiscal year 2025, down from 852 the year before. Families tend to ask the same five questions. Because the vehicles and cause are not yet known, the family can start by protecting evidence.
Can a claim start before police release a cause?
Yes. Waiting for the final report is not required, and evidence such as vehicles, video, and vehicle data can disappear quickly. Early requests to preserve it matter.
Who can be held responsible?
That depends on what investigators find. Possible parties include a driver, a vehicle owner, a company if a work vehicle was involved, or a maintenance provider.
What if fault is shared?
Indiana bars recovery only when a claimant’s fault is greater than the combined fault of everyone else (IC 34-51-2-6). Fault can be shared among several people.
Who can file after a fatal crash, and by when?
A personal representative files for the family (IC 34-23-1-1), generally within two years of the death, which here means October 28, 2028. The estate may have separate claims.
What should the family do first?
Request the crash report and the investigator’s contact, ask that vehicles not be released, route insurance calls to one person, and keep funeral records.
