Pedestrian Accidents in Indiana
A driver striking a pedestrian raises questions that go beyond the moment of impact.
- Who may be liable: the driver of the vehicle, and potentially the city if a lack of lighting or crosswalk visibility contributed
- What investigators examine: witness statements, the driver’s speed and line of sight, roadway lighting before sunrise, and any nearby surveillance or dash camera footage
- Indiana follows a modified comparative fault standard, meaning a pedestrian can still recover compensation as long as they were less than 51% at fault
- Personal injury claims in Indiana generally must be filed within two years of the crash (IC 34-11-2-4), which puts the deadline at September 23, 2028
