Elkhart, IN – Two Drivers Injured in Crash on Walorski Parkway Near I-80 Roundabout

Two Drivers Injured in Crash on Walorski Parkway

Elkhart, IN (October 7, 2026) – At about 6:17 p.m. on Wednesday evening, the Elkhart County Sheriff’s Department responded to a two-vehicle crash on Walorski Parkway just east of the I-80 roundabout in Elkhart.

A Chevrolet Silverado heading north and exiting Walorski Parkway turned into the path of an eastbound Nissan Altima and struck the Altima’s passenger side, according to a report from ABC57. The Altima driver attempted to swerve. The two drivers are 25 and 28 years old.

Both drivers were taken by ambulance for medical treatment due to injuries, according to the report. The extent of their injuries was not released. The 28-year-old Silverado driver was cited for failure to yield the right of way.

This is a developing story. Details may change as the investigation continues.

Key Legal Points After a Car Accident in Elkhart, IN

Indiana law (IC 9-21-8) requires a driver entering a roadway from a private drive or turning across traffic to yield the right of way to vehicles already on the road. A citation for failure to yield is relevant evidence in an injury claim, but it does not settle civil liability on its own.

  • First steps: Get evaluated by a doctor even if you were released from the scene. Request the crash report from the Elkhart County Sheriff’s Department. Photograph the vehicles and the intersection before repairs begin.
  • Who may be liable: The cited Silverado driver bears the citation, but the investigation may also consider road design at the roundabout exit, signage, or sight-line obstructions. The Altima driver or a passenger may have a claim against the Silverado driver’s insurer.
  • If fault is shared: Indiana’s modified comparative fault rule (IC 34-51-2-6) reduces recovery by the injured person’s share of fault. Recovery is barred when that share exceeds 50 percent.
  • Insurance that may apply: The at-fault driver’s bodily injury liability policy is the primary source. If that limit is too low, the injured person’s own underinsured motorist coverage under IC 27-7-5-2 may fill the gap.
  • Deadline: IC 34-11-2-4 puts the filing deadline for a personal injury claim from this crash at October 7, 2028.
