Your Legal Questions After a Car Crash in Goshen, IN

Under Indiana’s modified comparative fault rule (IC 34-51-2-6), an injured person’s recovery is reduced by their share of fault and barred entirely when that share exceeds 50 percent. Even when fault appears to favor one driver, insurance companies often dispute liability.

Who may be liable when a vehicle pulls out of a parking lot into traffic?

The driver exiting a parking lot generally owes the right of way to traffic already on the road. Depending on the facts, the business property owner could also share responsibility if the lot design or signage contributed to the crash.

What if fault has not been determined yet?

A police report is one piece of evidence, but it does not decide a civil claim by itself. Witness statements, camera footage, and vehicle positions are all part of how fault is evaluated.

What should I do first after a crash like this?

Get evaluated at a hospital the same day, even without obvious pain. Request the crash report from the responding agency. Ask nearby businesses for any exterior camera footage before it is overwritten.

Can the property owner be held responsible?

Possibly. If limited sight lines, missing signage, or the design of the parking lot exit contributed to the crash, the property owner or its management company could share liability.

How long do I have to file a claim?

Under IC 34-11-2-4, the deadline for a personal injury claim from this crash is October 5, 2028.
