Elkhart, IN – Officer Hospitalized After Squad Car Strikes Parked Vehicle

Officer Hospitalized After Squad Car Strikes Parked Vehicle

Elkhart, IN (October 13, 2026) – An officer was hospitalized on the evening of October 13 after a marked Elkhart Police Department squad car struck a parked, unoccupied vehicle. The Elkhart Police Department said the officer was taken to the hospital for evaluation and treatment of what appeared to be a minor injury.

Elkhart police said the squad car was driving westbound on West Franklin Street. It struck the parked vehicle on the north side of the road, between South 5th Street and Franklin Court. The impact caused the squad car to roll and come to rest on its side.

The officer driving the squad car was able to get out of the vehicle and was treated by medics at the scene. No other injuries were reported.

The Elkhart County Sheriff’s Office is handling the investigation.

This is a developing story. Details may change as the investigation continues.

Steps to Take After a Collision Involving a Police Vehicle in Elkhart, IN

Indiana Crash Facts 2024, prepared for the Indiana Criminal Justice Institute, counted 200,035 collisions statewide in 2024. Of those, 166,720 caused property damage only and 20,612 involved a possible injury, a category the report ties to complaints of pain. A crash that looks minor at the curb can still leave someone sore a day later.

Anyone affected by a crash like this can start with these steps, which protect the details that fade fastest:

  • Ask the Elkhart County Sheriff’s Office, which is handling the investigation, for the crash report number. Insurers and attorneys both work from it.
  • Photograph the vehicle damage, the debris, and the street before a tow truck moves anything.
  • Keep the tow yard’s name and every towing or storage receipt.
  • Look for cameras on nearby storefronts and doorbells, since footage gets overwritten quickly. Write down the names of anyone who saw the crash.
  • Get checked within 72 hours if you were in or near the crash, since neck pain, headaches, and numbness can surface late.
  • Tell your own insurer promptly and ask about rental and loss-of-use coverage.

When a City Police Vehicle Is Part of a Crash in Indiana

A squad car belongs to a city police department, and that changes the timeline for any claim. The Indiana Tort Claims Act allows claims against local governments but requires written notice to the city within 180 days of the loss (IC 34-13-3-8).

This crash happened on October 13, 2026, so notice would be due by April 11, 2027. Missing that notice can end a claim before it starts, even though the ordinary filing deadline runs to October 13, 2028. The Act also contains immunities, so an attorney has to review whether a particular claim fits. The notice goes to the city’s governing body, and a lawyer confirms whether any other office must receive a copy.

A lawyer can use Indiana’s Access to Public Records Act (IC 5-14-3) to request the crash report and the squad car’s maintenance file. Agencies may withhold law enforcement investigatory records, so requests are narrow and specific.

A parked vehicle’s owner can seek repair or replacement costs, towing and storage, and rental expenses. Anyone who was hurt can add medical bills and lost income.

  • The city that operates the squad car may be liable, along with any other driver, vehicle defect, or road condition investigators identify.
  • Investigators in a single-vehicle crash look at road surface, signage, lighting, brakes, tires, and weather before assigning cause.
  • Indiana bars recovery for a claimant more than 50 percent at fault and reduces it below that line (IC 34-51-2-6).
  • The two-year filing deadline under IC 34-11-2-4 falls on October 13, 2028.
