Car Accidents in Indiana
Even when injury details are still coming in, the steps taken in the first hours after a crash matter.
- See a doctor the same day, even if nothing feels seriously wrong right away
- Avoid giving a recorded statement to the other driver’s insurance company before speaking with an attorney
- Preserve evidence: photos of the vehicle damage, the deputy’s report, and any dashcam or nearby surveillance footage
- Do not accept a settlement offer before consulting an attorney, since Indiana’s modified comparative fault rule can affect what you are owed if the driver disputes fault
Personal injury claims in Indiana generally must be filed within two years of the crash (IC 34-11-2-4), which puts the deadline at September 22, 2028.

The vehicle damage, the deputy’s scene photos, and any nearby dashcam footage are the clearest record of what happened, and that record fades fast once tow trucks clear the road.
