Indian Birth Trauma Attorneys Can Help You Seek Compensation

Cerebral palsy (CP) is a neurological disorder caused by a non-progressive brain injury or malformation that occurs while a child’s brain is under development. Cerebral palsy can be caused by brain damage, usually a brain injury or abnormal development of the brain. This can occur before birth, during birth, or immediately after birth. CP affects body movement, muscle control, muscle coordination, muscle tone, reflex, posture, and balance. It can also impact a child’s fine motor skills.

About 10% to 15% of all children born with cerebral palsy were victims of medical malpractice or negligence. Cerebral palsy can be caused by a physician failing to diagnose likely delivery risks, failing to deliver a baby despite signs of stress, and failing to treat congenital disorders after birth. Medical negligence in CP cases can include:

  • Delaying delivery of the infant, causing oxygen deprivation
  • Failing to diagnose or misdiagnosing infections or other medical issues
  • Failing to properly use forceps or vacuum extraction during delivery
  • Failing to identify umbilical cord problems, such as a prolapsed cord
  • Failing to properly monitor fetal and/or maternal distress

Experienced Legal Representation for Cerebral Palsy Claims

Due to the serious and sensitive nature of cerebral palsy cases, injury claims are handled differently and should be handled by an experienced attorney. Cerebral palsy can cost the afflicted and their families a significant amount of money for medical treatments and in-home care. Cerebral palsy lawsuits usually seek compensation from the party who caused the injury. An example of this would be the parents of an infant who developed CP due to medical malpractice, filing a claim against the physician, hospital, and/or whoever else is responsible for the baby’s injuries. In addition to legal compensation, some people file cerebral palsy claims in order to:

  • Prevent similar incidents for occurring again
  • Get an explanation as to how and why the birth injury occurred
  • Hold those involved accountable for their actions.
