Motorcycle Accidents in Delaware County, IN
Motorcycle accidents in Delaware County often occur on high-speed routes like State Road 332 and near the I-69 interchange. Common causes include speeding, failure to yield, and distracted driving, particularly during left-hand turns. Because motorcyclists lack physical protection, these collisions often result in catastrophic injury or death.
Under Indiana Code § 34-11-2-4, the statute of limitations for personal injury or wrongful death is two years. If a government vehicle or roadway defect is involved, a Tort Claim Notice must be filed within 180 days (municipal) or 270 days (state). Since Indiana uses modified comparative negligence, insurers may use speed reports to shift fault to the rider. Navigating these tactics makes consulting a motorcycle accident lawyer essential to protecting your rights.
