Clinton County, IN (Mar 10, 2026) – The Indiana State Police are investigating a serious two-vehicle accident that occurred Tuesday at approximately 1 p.m. at the intersection of State Road 28 and County Road 200 West. A Subaru traveling westbound attempted to turn south when it was struck by an eastbound commercial semi-truck.
The Subaru driver sustained serious injuries and was transported to a hospital in Indianapolis.
While the truck driver was uninjured, the collision triggered a hazmat response due to a significant oil leak that closed the highway for over three hours.
Indiana Trucking Liability
Indiana operates under a modified comparative fault system (IC § 34-51-2-6), which allows a victim to recover damages even if they are partially responsible, as long as their fault is 50% or less. While preliminary reports may focus on the Subaru’s turn, a thorough legal investigation must determine if the semi-truck was speeding or if the driver was fatigued. Preserving the truck’s Electronic Logging Device (ELD) and “black box” data is critical, as this objective evidence can prove if the commercial driver failed to exercise due care to avoid the collision.
