Fatal Accidents in Indianapolis, IN
Fatal accidents at high-speed interchanges like the I-70 and Sam Jones Expressway junction are often caused by distracted driving, unsafe merging, or road hazards. Under Indiana Code § 34-11-2-4, the statute of limitations for filing a wrongful death claim is two years. If a government vehicle or roadway defect is involved, a Tort Claim Notice must be filed within 180 days (municipal) or 270 days (state).
Because Indiana uses modified comparative negligence, insurance companies frequently attempt to shift fault to the deceased to reduce liability. Given these complex legal and insurance hurdles, consulting an experienced attorney is a critical step in preserving evidence and protecting a family’s rights.
