Multi-Vehicle Accident in Indiana
Multi-vehicle accidents at high-speed highway junctions like US-31 and State Road 10 often present complex legal challenges regarding right-of-way and comparative fault.
Under Indiana Code § 34-11-2-4, victims or their surviving family members generally have two years from the date of the incident to file a personal injury or wrongful death claim. However, this timeframe is significantly shorter, requiring a formal notice within 180 to 270 days if the accident involves a government-owned vehicle or a failure in roadway maintenance by a state or local agency.
In the aftermath of a catastrophic multi-vehicle crash, it is essential to act quickly to secure evidence such as “black box” data, witness statements, and forensic scene mapping. Because Indiana follows a modified comparative negligence rule, insurance companies may attempt to shift blame to reduce the compensation they owe.
